MDE has petitioned the Administrative, Executive, and Legislative Review (AELR) Committee of the Maryland General Assembly requesting emergency status for the regulation(s) listed below.
If the Committee grants its approval, the emergency measure may go into effect immediately. The Committee imposes a time limitation on the duration of the emergency regulation. To become a permanent regulation, the regulation must be promulgated following the State required administrative procedures, which includes a 30-day public comment period.

The Joint Committee on Administrative, Executive, and Legislative Review has granted emergency status to new Regulations .01—.07 under a new chapter, COMAR 26.04.12 On-Site Wastewater Property Transfer Inspection License. These regulations were published in the Maryland Register on 9/23/22.
The Emergency status began on August 24, 2022 and the emergency status expires on February 20, 2023. MDE will work on a regular promulgation process to comply with Acts 2021, c. 444, § 1, eff. Oct. 1. 2021; Acts 2021, c. 445, § 1, eff. Oct. 1, 2021. To become a permanent regulation, the regulation must be promulgated following the State required administrative procedures, which includes a 30-day public comment period. Once the regular process is completed, it will replace the emergency regulations, anticipated by the end of the calendar year.
